Mobiz is a powerful tool to assist in maintaining marketing-related compliance measures. Manage your customer data lists, implement gate-keeping tools, FICA your clients, and allow for secure third-party payment integrations, all inside the Mobiz environment.
Note: It is important to familiarise yourself with local compliance rules and regulations. Mobiz can provide best practice tools for you to use, but it is ultimately up to you to enforce these and follow the applicable law.
Below are some of the ways Mobiz makes compliance easy.
Opt-ins and opt-outs
Opt-ins and opt-outs allow people to intentionally and expressly select to join in communication to a particular service or to stop a marketing communication.
Opt-in features offered include text-to-join (trigger campaigns), QR code sign-ups, form submittals, call-back CTAs, and more. You can learn about these in the 'Using Mobiz' section of this Knowledge Base.
Opt-outs work in a similar way and can help you keep track of customers who no longer want to be listed on your marketing database or a previously selected service. SMS copy dispatched to end-users must indicate an opt-out method, for example, "Reply STOP to opt-out".
Mobiz follows the guidelines set out by WASPA and as such, the keyword we make use of is 'STOP'.
Customers that choose to opt-out by sending the chosen keyword will be added to a unique list that can be viewed on your Brands dashboard. Use this list to manage your customer database on your existing CRM.
Opt-out requests from the customer will only be successful if the message contains the exact keyword. We recommend monitoring the SMS replies dashboard for customers who have expressed the desire to opt-out but did not use the correct keyword.
Data scrubbing
Mobiz can assist in cleaning your data by identifying incomplete, incorrect, inaccurate, or irrelevant parts of your data lists. Monitor the integrity of your data by viewing undelivered, duplicates, or otherwise unusable data entries, thus improving your return on investment.
Pull reports from your Enterprise Analytics dashboard to view Invalid Phone Numbers and Delivery Error logs.
Built-in functions will auto-identify and exclude invalid numbers, those that are too long, or those on the opt-out or stop list.
Gatekeeping
Depending on your industry, you may wish to implement certain gatekeeping strategies to ensure that your engagements, campaign, or data-capturing do not infringe on applicable laws.
For example, if you are in the liquor or cigarette industry and are prohibited from marketing to minors, you can use our tools to ensure that these restrictions are put in place as a “gate” of control.

FICA your customers
The Financial Intelligence Centre Act 38 of 2001 ("FICA") was instituted in order to fight financial crimes such as money laundering, fraud, tax evasion, terrorist financing activities, and identity theft.
You can ensure that you remain FICA-compliant by asking your customers to upload the necessary documentation required to verify, for example, their proof of identity, tax information, and income statements This streamlines the usually complicated process and encourages higher numbers of successful applications.
Secure payments
Mobiz works with several registered and authorized third-party payment providers in order to help your customers make secure and easy payments without having to leave the Mobiz environment.
This can ensure you remain compliant with FICA legislation as mentioned above, as well as other payment laws.
CPA, ECTA, and POPIA
Electronic direct marketing (online services, emails, SMSes, faxes, telephone, and/or automatic calling machines) is governed largely by three main compliance acts in South Africa, being:

Scheduling and time guidelines
The CPA, in its Section 12 (2) and regulations, sets a limitation on the times that a consumer may be contacted for purposes of direct marketing. It outlines that consumers may not be contacted during the following times and/or days:
Sundays or public holidays;
Saturdays before 09h00 and after 13h00; and
all other days between the hours of 20h00 and 08h00 the following day.
It is essential to schedule your campaigns to deploy with these guidelines in mind to ensure you remain compliant.
